1. Services

BuildSmart AI provides custom AI system implementation services for general contractors and specialty trades. Our services include but are not limited to: AI-powered lead capture, automated estimating tools, field operations management, document automation, and collections automation.

Services are provided under a separate Statement of Work (SOW) or service agreement that details deliverables, timelines, and pricing specific to each client engagement.

2. Free AI Audit

The free AI Audit consultation is provided at no charge and carries no obligation to purchase. It is a 45-minute consultation designed to assess your business operations and identify potential AI applications. The audit does not constitute a binding agreement for any services.

3. Payment Terms

Payment terms for BuildSmart AI services are as follows:

• Specific payment schedules are outlined in each client's service agreement or SOW
• Invoices are due within 15 days of issuance unless otherwise agreed in writing
• Late payments may be subject to a 1.5% monthly finance charge
• All fees are in USD unless otherwise specified

4. 90-Day Build Guarantee

BuildSmart AI guarantees delivery of agreed-upon AI systems within 90 days of contract execution, provided the client fulfills all required cooperation obligations including timely access to necessary systems, information, and personnel.

If BuildSmart AI fails to deliver the agreed systems within the 90-day window due to reasons within our control, and the systems do not perform as specified, the client may request a full refund. Delays caused by client non-cooperation, force majeure, or third-party API limitations do not trigger this guarantee.

5. No Guarantee of Specific Results

While we share typical results from our client base, BuildSmart AI does not guarantee specific business outcomes such as revenue increases, lead volume, or time savings. Results vary based on business type, market conditions, client follow-through, and other factors outside our control. Testimonials and statistics on our website represent individual results and are not guarantees of future performance.

6. Intellectual Property

Upon full payment, clients receive a license to use the AI systems built for their business. BuildSmart AI retains ownership of underlying frameworks, methodologies, and generic tools used in development. Custom configurations specific to your business are yours to use.

7. Confidentiality

Both parties agree to keep confidential any proprietary business information shared during the engagement. BuildSmart AI will not disclose client business information to competitors or unauthorized third parties.

8. Limitation of Liability

BuildSmart AI's total liability for any claim arising from our services shall not exceed the total fees paid by the client in the 3 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Governing Law

These Terms of Service are governed by the laws of the State of Florida, United States. Any disputes arising from these terms or our services shall be resolved in the courts of Broward County, Florida, or through binding arbitration as mutually agreed.

10. Changes to Terms

We reserve the right to update these Terms of Service. Continued use of our services after notification of changes constitutes acceptance of the updated terms.
